BOOKING CONDITIONS
1. About these conditions
These Booking Conditions apply to direct bookings for the Farmhouse and The Wren at Boothorpe Farm.
“We”, “us” and “our” mean Mr and Mrs G Humphreys, Hamel House, Boothorpe, Derbyshire DE11 8BL.
“You” and “your” mean the person making the booking and all members of their party.
By completing a booking, you confirm that you have read and accepted these Booking Conditions on behalf of everyone included in the booking.
Your booking is for temporary holiday accommodation only. It does not create an assured shorthold tenancy or give you any right to remain at the property after the agreed departure time.
2. Making a booking
The person making the booking must:

Be at least 18 years old;
-
Have authority to accept these conditions on behalf of everyone staying at the property;

Ensure that all booking information is complete and accurate; and
-
Be responsible for all payments and for the conduct of the entire party.
A booking is confirmed when we have received the required payment and issued a booking confirmation by email.
Please check your confirmation carefully and notify us promptly if anything is incorrect.
We reserve the right to refuse a booking before confirmation and will promptly refund any payment received.
3. Prices
The price displayed during the booking process is for the accommodation as a whole and not per person, unless expressly stated otherwise.
The total price will include any compulsory charges disclosed during booking. Optional extras and charges arising during your stay may be payable separately.
Prices for unbooked dates may be changed at any time. Once a booking has been confirmed, its price will not normally change unless you request an amendment.
If an obvious pricing or technical error occurs, we will contact you as soon as possible. You may accept the corrected price or cancel and receive a full refund.
4. Payment
Full payment is required when the booking is made.
Payments must be made in pounds sterling using one of the payment methods offered during the booking process.
5. Changes requested by you
If you wish to change your dates, accommodation or party details, please contact us in writing as soon as possible.
We will try to accommodate reasonable requests, but changes are subject to availability and cannot be guaranteed.
Any increase in price must be paid before the change is confirmed. If the revised booking costs less, we will tell you whether a refund is available, taking account of any loss or reasonable costs caused by the change.
A change is only confirmed when we have agreed to it in writing.
6. Cancellation by you
You must notify us by email as soon as possible if you wish to cancel. Your cancellation takes effect when we receive it.
Any cancellation charge will reflect the loss and reasonable costs resulting from the cancellation. We will take reasonable steps to reduce our loss, including attempting to rebook the dates.
If we successfully rebook all or part of your cancelled stay, we will refund the amount recovered through the replacement booking, less any difference in price and reasonable costs directly resulting from the cancellation.
We strongly recommend that you obtain suitable UK travel insurance covering cancellation, illness, emergencies and interruption of your stay.
Bookings for accommodation on specified dates do not normally benefit from the statutory 14-day cooling-off period applicable to some online purchases.
7. Cancellation or changes by us
We do not expect to cancel or make a significant change to your booking. However, circumstances may occasionally make this necessary.
If we have to cancel your booking before arrival, we will offer you:

Alternative dates, if suitable and available; or
-
A full refund of all payments made for the affected booking.
We will not be responsible for additional travel costs or the cost of alternative accommodation, except where the law requires otherwise.
Nothing in these conditions affects your statutory rights.
8. Events beyond our reasonable control
Neither party will be responsible for failing to perform obligations where this is caused by an event genuinely beyond their reasonable control.
Such events may include severe weather, flooding, fire, failure of public utilities, government restrictions, war, terrorism or another serious emergency.
This clause does not remove any right to a refund that you may have under applicable law where the accommodation cannot be provided.
9. Arrival and departure
Unless otherwise agreed in writing:

Check-in is from 4pm on the arrival date; and
-
Check-out is by 10am on the departure date.
Please tell us if you expect to arrive after 8pm.
If you do not arrive and have not contacted us by 12 noon on the day following your scheduled arrival, we may treat the booking as cancelled.
10. Occupancy and visitors
The number of people staying must not exceed the maximum occupancy stated for the property:

The Farmhouse: maximum six guests;
-
The Wren: maximum two guests.
Only people included in the confirmed booking may stay overnight.
Visitors, parties, celebrations, meetings, commercial activities and events require our prior written permission.
The property must not be sublet or used for any illegal or unauthorised purpose.
A serious breach of these requirements may result in the booking being terminated without a refund, subject to applicable law.
11. Behaviour
You and your party must:
-
Behave responsibly and considerately;
-
Avoid excessive noise or disturbance;
-
Respect neighbours, other guests and staff;
-
Keep the property reasonably clean and tidy; and
-
Comply with all reasonable safety and property instructions.
We may terminate a stay if serious or persistent antisocial, abusive, threatening, illegal or dangerous behaviour occurs.
12. Dogs and other animals
Dogs are welcome where they have been included in the booking. A charge of £20 per stay applies and covers all dogs included in the booking.
Dogs must:

Remain downstairs in the Farmhouse;
-
Be kept off beds and furniture;
-
Be cleaned and dried after walks;
-
Not be left unattended in the accommodation or garden;
-
Be kept under proper control; and
-
Not cause excessive noise, damage or nuisance.
Other animals may only be brought with our prior written agreement.
We cannot guarantee that the accommodation has previously been free from animals and cannot accept responsibility for allergic reactions unless caused by our negligence.
13. Smoking
Smoking and vaping are not permitted inside either property.
You will be responsible for reasonable cleaning, repair or replacement costs caused by a breach of this condition.
14. Care of the property and damage
You are responsible for the property during your stay.
Please report any existing damage or missing items as soon as reasonably possible after arrival.
You must notify us promptly of any breakage, damage, loss or maintenance problem occurring during your stay.
You will be responsible for the reasonable cost of repairing damage or replacing missing items caused by you, your party, your visitors or your animals, except for normal wear and tear.
If the property requires exceptional cleaning because it has been left in an unreasonable condition, we may charge the reasonable additional cleaning cost.
We will provide details and supporting information for any charge claimed.
15. Security deposit
We may require a refundable security or good-housekeeping deposit.
If a security deposit applies, its amount, payment arrangements and return conditions will be clearly disclosed before the booking is completed.
We may make reasonable deductions for damage, missing items, exceptional cleaning or other losses caused by a breach of these conditions. Any proposed deduction will be explained to you.
16. Access to the property
We or our appointed representatives may enter the property where reasonably necessary:

In an emergency;

To carry out urgent repairs or safety checks;

To investigate a reported problem; or
-
Where we reasonably believe that these Booking Conditions are being seriously breached.
We will give reasonable notice whenever practical.
17. Facilities and Wi-Fi
We take reasonable care to ensure that the property descriptions and photographs are accurate.
Minor differences may arise because of maintenance, improvements or replacement furnishings.
Wi-Fi is provided for normal recreational use and is subject to availability, network coverage and circumstances outside our control. We cannot guarantee that it will be uninterrupted or suitable for business-critical use.
Please notify us promptly if an advertised facility is unavailable so that we have a reasonable opportunity to investigate and, where possible, resolve the problem.
18. Accessibility and medical requirements
Please contact us before booking if anyone in your party has a disability, medical condition or accessibility requirement that may affect their stay.
We will provide the information reasonably available to help you decide whether the property is suitable.
Special requests are not guaranteed unless we have expressly confirmed them in writing.
19. Problems and complaints
Please contact us immediately if a problem arises during your stay. This gives us an opportunity to investigate and resolve it while you are at the property.

20. Our responsibility
We are responsible for providing the accommodation with reasonable care and skill and in accordance with the confirmed booking.
We are not responsible for:
-
Loss or damage that was not reasonably foreseeable;

Noise or disturbance originating beyond the property and outside our reasonable control;
-
Failure of public utilities outside our reasonable control; or
-
Loss connected with a business, trade or profession.
Nothing in these conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory rights.
21. Personal information
We will use the personal information supplied in connection with your booking to administer the reservation, process payment, communicate with you and comply with our legal obligations.
Payment information may be processed securely by our booking or payment provider.
22. Governing law
These Booking Conditions are governed by the law of England and Wales.
As a consumer, you retain any mandatory legal rights that apply where you live. Any dispute may be brought before a court with jurisdiction under applicable consumer law.
